Terms of Service

These Terms of Service (“Terms”) govern your use of serenibrain.com, the SereniBrain mobile application, SereniBrain products, and related services. The services are provided by South China Brain Control (Guangdong) Intelligent Technology Co., Ltd. under the SereniBrain brand.

By accessing or using the services, creating an account, or placing an order, you agree to these Terms. If you do not agree, do not use the services.

1. Eligibility and accounts

You must be legally capable of entering into a binding agreement to make a purchase. The App is intended for users aged 13 or older; users under the age of majority must have permission from a parent or legal guardian. You are responsible for information submitted through your account and for keeping account credentials secure.

2. Consumer wellness product

SereniBrain is a consumer wellness and training product. It records EEG activity and provides feedback intended to support meditation, attention, and self-observation. It is not a medical device and is not intended to diagnose, treat, cure, prevent, or monitor any disease or medical condition.

Scores, brainwave bands, feedback, and reports are informational training outputs, not medical advice or a clinical assessment. Do not use SereniBrain as a substitute for professional medical care. Stop using the product and seek appropriate advice if you experience discomfort or have concerns about whether it is suitable for you.

3. Product and service information

We try to describe products, features, compatibility, prices, and availability accurately. Displays, colors, packaging, App features, and specifications may change or appear differently depending on the device. We may correct errors, update information, limit quantities, or discontinue a product or feature where permitted by law.

4. Orders and payment

Placing an order is an offer to purchase. We may accept, reject, or cancel an order for reasons including payment failure, suspected fraud, pricing error, stock unavailability, shipping restrictions, or legal requirements. Prices, shipping charges, discounts, and applicable taxes are shown during checkout. Payments are processed by third-party payment providers.

5. Shipping, returns, and warranty

Direct website orders are subject to our Shipping and Returns Policy. Eligible SereniBrain headbands include the coverage described in our 12-Month Limited Warranty. Marketplace purchases, including Amazon orders, are also subject to the marketplace terms shown for that order.

6. App licence

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to install and use the App with supported SereniBrain products for personal, non-commercial purposes. The App and its content are licensed, not sold.

You may not copy, sell, rent, sublicense, distribute, reverse engineer, bypass security controls, interfere with operation, scrape the services, introduce malicious code, or use the services to violate law or another person’s rights, except where applicable law expressly permits an activity that cannot be restricted by contract.

7. Training content

Meditations, courses, audio, visual feedback, reports, and educational content are provided for general information and practice. Individual experiences and results vary. We do not guarantee a particular score, outcome, improvement, or result.

8. Intellectual property

The SereniBrain name, software, website, product designs, graphics, text, audio, video, courses, and other content are owned by or licensed to us and are protected by applicable intellectual-property laws. These Terms do not transfer ownership to you.

9. Privacy

Our handling of personal information is described in the Privacy and Data Policy. Raw EEG signals, processed brainwave metrics, session scores, training history, and reports are stored locally on the user’s device and are not uploaded to SereniBrain servers.

10. Third-party services

The services may rely on or link to third parties, including Shopify, payment providers, Amazon fulfillment services, Apple, Google, Bluetooth services, and delivery carriers. Their services are governed by their own terms and privacy practices. We are not responsible for third-party services except where applicable law provides otherwise.

11. Availability and updates

We may maintain, update, modify, suspend, or discontinue parts of the website or App. Internet, Bluetooth, device, operating-system, and third-party-service limitations may affect availability. We do not guarantee uninterrupted or error-free operation.

12. Disclaimer

To the maximum extent permitted by law, the services are provided “as is” and “as available.” We disclaim implied warranties except for warranties that cannot lawfully be excluded. This section does not limit the express 12-month limited warranty or mandatory consumer rights.

13. Limitation of liability

To the maximum extent permitted by law, SereniBrain will not be liable for indirect, incidental, special, consequential, or punitive damages, loss of profits, loss of data, or loss of opportunity arising from use of the services. Where liability cannot be excluded, our aggregate liability relating to a product or service will not exceed the amount paid for the product or service giving rise to the claim, unless applicable law requires otherwise.

14. Governing law and disputes

These Terms are governed by the laws of the People’s Republic of China, without regard to conflict-of-law rules. The courts located in Guangzhou, Guangdong, China have non-exclusive jurisdiction over disputes relating to these Terms.

This choice of law and jurisdiction does not deprive a consumer of mandatory protections or the right to bring a claim in another forum where those rights cannot lawfully be waived under the law of the consumer’s place of residence.

15. Changes to these Terms

We may update these Terms to reflect changes in our services, business, or legal obligations. The current version and effective date will be posted on this page. Where required, we will provide additional notice.
